根据《2012年第2号法规:公共用地征用》,考虑到公共利益和发展之间的平衡,需由政府进行公共用地征用。电力传输、电网、网络和配电等设施以及发电厂的征用被视为公共用地征用。

Pursuant to Law No. 2 Year 2012 concerning Land Procurement Due to Development Purported for Public Interests, the procurement of land for public interest purposes shall be conducted by the Government, taking into account the equal balance between development and public interest purposes. The procurement of power plant and installations for electricity transmission, grid, network, and distribution are considered as public interests.

需要开垦土地的机构应该进行可行性研究,并制定土地征用计划,以供政府进行审议,这份计划至少应包含以下内容:

The institutions which are in need of cleared land shall conduct a feasibility study and develop a masterplan for land procurement as a material for consideration by the provincial Government, consisting of the minimum information, among others:

a.发展目的和目标
The purposes and aim of development;

b.符合区域空间规划和国家空间规划
Conformity with the Regional Spatial Planning and the National-Regional development planning;

c.土地位置
Location of land;

d.项目所需要的土地面积
The total land area required for the project;

e.土地基本概况
General information on land status;

f.土地征用和项目施工预计时间
Time estimation for land procurement and project construction

g.土地价值预估
Estimation of land value; 和and

h.预算规划
Budgetary planning.

土地征用的法定流程如下:

The procedures as stipulated by law concerning land procurement are as follows:

- 宣布建设计划
announcement of construction planning;

- 数据清单和土地占有、持有、使用和利用情况,这些情况交由土地局进一步进行修改和/或核实
data inventory and identification of land occupation, ownership, usage, and utilization which shall then be further revised and/or verified by the Land Bureau;

- 就项目发展计划进行公共咨询
public consultation concerning the project development plan;

- 补偿措施评估和协商,以及资金;和
appraisal and negotiation concerning the compensatory settlement, as well as the endowment of such settlement; and

- 土地权让渡(以土地转让权为准,后续将作为土地登记/证明依据)
Relinquishment of the rights over land (as shown in an official report of rights relinquishment, which will subsequently be used as the basis for land registration/certification).

 

在土地征用过程中可能遇到的风险及其解决建议如下 :

土地征用是投资者在印尼投资时普遍面临的问题,其后续会因为附加成本或项目筹备和建设附加时间而影响到电力营业。因此,我们鼓励投资者遵循上述土地征用相关法规,并尽早让公众参与到项目筹划。

Land procurement issues are among the most common faced by investors placing capital in Indonesia, which may subsequently affect the electricity business activities, either due to the additional costs of capital or the timeframe for project preparation and construction. Therefore, we hereby encourage the investors to comply with the prevailing laws concerning land procurement and foster public participation starting as early as in the project planning phase.
